Terms of Use for Khazna Data Centers
Effective Date: August 1, 2025
This website, located at uniform resource locator www.khazna.ae (the “Site”), is provided by Khazna Data Center Holdings Limited, a company established in Abu Dhabi Global Market (“ADGM”), Abu Dhabi, United Arab Emirates (“Khazna”, “we,” “our,” or “us”) to the person accessing the Site (“you,” or “your”).
These Terms of Use (“Terms”) govern your access to and use of the Site.
If you accept or agree to these Terms on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms and, in such event, “you” and “your” will refer and apply to that company or other legal entity.
If you do not agree to these Terms without limitation or qualification, you must exit the Site immediately.
1. Acceptance of Terms
By accessing our Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. These Terms constitute a legally binding agreement between you and Khazna. If you are using our Site on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
We reserve the right to modify these Terms at any time and without notice, by revising them on our Site. Your continued use of our Site after such modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically to stay informed of any changes. If you do not agree to any updated Terms without limitation or qualification, you must exit the Site immediately.
2. Eligibility and Account Registration
To use our Site, you must be at least 18 years of age and have the legal capacity to enter into binding agreements. If you are using our Site on behalf of an organization, you represent and warrant that you are authorized to act on behalf of that organization.
To access certain features of our Site, you may be required to create an account. When creating an account, you agree to provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3. Acceptable Use Policy
The information and materials on the Site are provided for general informational purposes. You may use the Site solely for the purpose of learning about and/or using Khazna services or products. You may not use, reproduce or distribute the text, graphics, downloads, tools or any other content on the Site for any other purpose.
You agree to use our Site only for lawful purposes and in accordance with these Terms. You shall not use our Site :
3.1 Prohibited Activities
- To violate any applicable local, state, national, or international law or regulation.
- To transmit, store, or distribute content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable.
- To impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
- To transmit any material that contains software viruses, worms, trojan horses, or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment.
- To interfere with or disrupt the Site or servers or networks connected to the Site, or disobey any requirements, procedures, policies or regulations of networks connected to the Site.
- To attempt to gain unauthorized access to any portion or feature of the Site, or any other systems or networks connected to the Site or to any server, computer, network or database connected to the Site.
- To attack the Site via a denial-of-service attack or a distributed denial-of-service attack.
- To use any automated means, including robots, spiders, scrapers, or other automated tools, to access the Site for any purpose without our express written permission.
- To collect or store personal data about other users without their express consent.
- To use the Site for any commercial purpose without our prior written consent, except as expressly permitted by any other agreements you have with us.
3.2 Content Standards
The Site may, from time to time offer interactive features that allow users to submit content to the Site. Khazna does not and cannot review all such content, and is not responsible for such content.
You acknowledge that by providing the ability to view and distribute your user-generated content on the Site, Khazna is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability related thereto. However, Khazna reserves the right to block or remove communications or materials that it determines to be unacceptable to Khazna in its sole discretion.
You are solely responsible for the content you store or transmit or upload through our Site.
Misuse of the Site will be treated seriously and dealt with in accordance with UAE law. Without limitation, (i) harassment in any manner or form on the Site, including via e-mail, chat, or by use of obscene or abusive language, or posting any obscene or abusive images or text, is strictly forbidden and (ii) you may not upload to, distribute, or otherwise publish through the site any content which is libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law.
4. Intellectual Property Rights
4.1 Our Intellectual Property
The Site and all materials therein, including but not limited to software, text, graphics, logos, icons, images, audio clips, video clips, data compilations and the design, selection, and arrangement thereof, are owned by Khazna or our licensors and are protected by intellectual property laws. All trademarks, service marks, and trade names used in connection with the Site are the property of Khazna or their respective owners.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site solely for your authorized purposes in accordance with these Terms. This license does not include any right to:
- Resell or make commercial use of the Site or any content therein.
- Make derivative works of the Site or any content therein.
- Download, copy or use any account information for the benefit of any third party.
- Use any data mining, robots, or similar data gathering and extraction tools.
4.2 Your Content
You retain ownership of any intellectual property rights that you hold in content that you upload, store, or transmit through our Site (“Your Content”). By using our Site, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, distribute and display Your Content solely as necessary to provide the Site to you.
You represent and warrant that you have all necessary rights to grant us this license and that Your Content does not infringe upon the intellectual property rights of any third party.
4.3 Copyright Complaints

5. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Site, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy. Any other communication or material you transmit to the Site, such as questions, comments, suggestions or the like, will be treated as non-confidential and non-proprietary.
We implement appropriate technical and organizational measures to protect your data, but you acknowledge that no method of transmission over the Internet or electronic storage is completely secure from viruses or other harmful components. You are responsible for maintaining appropriate security measures for your own systems and data.
6. Third Party Links
Khazna may link to sites operated by third parties. However, even if the third party is affiliated with Khazna, Khazna has no control over these linked sites, all of which may have separate privacy and data collection practices, independent of Khazna. These linked sites are only for your convenience and therefore you access them at your own risk.
Without limiting the foregoing, Khazna specifically disclaims any responsibility if such sites:
- infringe any third party’s intellectual property rights;
- are inaccurate, incomplete or misleading;
- are not merchantable or fit for a particular purpose;
- do not provide adequate security;
- contain viruses or other items of a destructive nature; or
- are libellous or defamatory.
Additionally, Khazna does not endorse the content, or any products or services available, on such sites.
7. Notices; Electronic Communications
When you visit the Site or send e-mails to Khazna, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on the Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
8. Disclaimers and Limitation of Liability
8.1 Disclaimers
The services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Khazna Data Centers disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement.
We do not warrant that the Site will be uninterrupted, error-free or completely secure from viruses or other harmful components. We do not warrant that the results obtained from the use of the Site will be accurate or reliable.
8.2 Limitation of Liability
To the fullest extent permitted by law, in no event shall Khazna Data Centers, its officers, directors, employees, agents or suppliers be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of profits, data, use, goodwill or other intangible losses, arising out of or relating to your use of the Site.
9. Indemnification
You agree to defend, indemnify and hold harmless Khazna, its officers, directors, employees, agents and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to:
- Your use of the Site.
- Your violation of these Terms.
- Your violation of any rights of another party.
- Your Content or any content you upload, store, or transmit through the Site.
10. Termination
We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including but not limited to your breach of these Terms. Upon termination, your right to use the Site will cease immediately.
You may terminate your account at any time by following the account closure procedures specified in your service agreement or by contacting our customer support. Upon termination by either party, you remain liable for all fees and charges incurred prior to termination.
Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitations of liability and indemnification.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates and the Abu Dhabi Global Market (“ADGM”), without regard to its choice of law principles. Any disputes arising out of or relating to these Terms and/or the Site or in which these Terms and/or the Site are a material fact shall be subject to the exclusive jurisdiction of the ADGM Courts.
12. Miscellaneous
12.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Khazna regarding the Site and supersede all prior and contemporaneous agreements, proposals, or representations, written or oral, concerning the subject matter hereof.
12.2 Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely reflects the intent of the original provision.
12.3 Waiver
No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
12.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section shall be void. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors and permitted assigns.
